A luxury eyewear company is striking back against a proposed class action stemming from a data breach, arguing that the plaintiffs don’t have the standing to bring claims in Ohio federal court.

The lawsuit against Luxottica of America Inc. should be dismissed because the plaintiffs don’t allege injury sufficient to confer Article III standing, the company argued in a motion filed March 19 in the U.S. District Court for the Southern District of Ohio.
